Right and Privileges of Advocates

  1. Right to practice
  2. Right to refuse the case
  3. Right of fee- no limit- no fee and no case.

Privileges

  1. Clime audience– an advocate can sit in any court- bench and the bar the two main limes of judiciary and one without other can’t function. It is therefore necessary the harmony between the two must be maintained. The bench and the bar should give due respect.
  2. Free from arrest – no one can arrest an advocate when he is going to the court. Sec.135(2) CPC 1908 exempted.
  3. Immunity from liability – reasonable mistake. No action taken against the advocate when act is ordinary negligence and reasonable man such mere negligence act or privileged.
  4. Privilege of being offered judges– only advocate can become a judge
  5. Privilege of political life.
  6. Privilege of independence-he fight for justice. He never required answering to anyone except god.
  7. Privilege of communication – sec. 126 of Indian evidence -secretes not required to disclose.- “No one is stopping you from going to office. Needless to say, lawyers’ offices are exempted” : SC to Delhi Bar Association 2020 – even in lockdown one state to another state.

These are extra rights over then Citizen
